In a significant move to strengthen the protection of women and children, the West Bengal Legislative Assembly has passed the Aparajita Woman & Child (West Bengal Criminal Laws Amendment) Bill 2024. The legislation introduces stringent penalties for sexual violence, including life imprisonment without parole for rape and a minimum sentence of ten years for child sexual abuse, with the possibility of extending it to life imprisonment in severe cases.
The bill also mandates the creation of fast-track courts dedicated to cases of sexual violence, aiming to deliver swift justice. These courts are expected to reduce delays in the judicial process, ensuring that survivors receive timely resolutions. Additionally, the bill emphasizes the importance of survivor support by establishing specialized counseling centers across the state, providing psychological aid, legal assistance, and guidance.
Furthermore, the bill includes provisions for educational initiatives aimed at preventing sexual violence. Schools and colleges across West Bengal will now be required to integrate lessons on gender sensitivity and sexual violence prevention into their curricula, promoting a culture of respect and equality.
While the Aparajita Bill has garnered widespread support from women’s rights activists and social organizations, some political factions have raised concerns about the potential for misuse of its harsh penalties. Despite this, the bill is seen as a crucial step forward in ensuring the safety and dignity of women and children in West Bengal.
